TERMS & CONDITIONS

This is an agreement between you (the Customer) and Catalyst Brew Pty Ltd (ABN ) (Catalyst Brew, we, us, our). It sets out the terms and conditions for accessing the website catalystbrewcoffee.com (the Website) and purchasing products through the Website.

Definitions

• Australian Consumer Law – Schedule 2 (The Australian Consumer Law) of the Competition and Consumer Act 2010 (Cth).

• Goods – the product(s) ordered by you from the Website.

• GST – as defined in the A New Tax System (Goods and Services Tax) Act 1999 (Cth).

• Price – the price of the Goods as displayed on the Website and as varied by Catalyst Brew from time to time.

• Registration Form – the form you must complete to register an account on the Website.

• Us or We – Catalyst Brew Pty Ltd

1  General

1.1  Your use of the Website and the purchase of Goods are subject to these terms and conditions (Terms of Use).
1.2  By registering or otherwise using the Website you agree to be bound by these Terms of Use. If you do not agree, do not use the Website.

2  Membership

2.1  You may become a member by completing the Registration Form. You warrant that all information provided is accurate, complete and current, and you will keep it up‑to‑date via your account. Your personal information is handled in accordance with our Privacy Policy.
2.2  You must be at least 18 years old to register or place an order.
2.3  Only one registration per email address is permitted. If you use a workplace email, you are responsible for compliance with workplace policies.
2.4  You must keep your password secure and notify Catalyst Brew immediately of any unauthorised use of your account.

3  Placing Orders – Acceptance & Rejection

3.1  Orders are placed electronically through the Website by logged‑in members only.
3.2  Goods are available for delivery within Australia only (or within nominated states, at our discretion).
3.3  The delivery address you nominate must be within a suburb serviced by Catalyst Brew. Orders with non‑serviced addresses will not be processed.
3.4  You warrant that all order details are accurate. You may be asked to confirm them before submission.
3.5  Your order becomes effective when the Website successfully processes your payment after you click “Submit Payment.” You cannot cancel or change the order after that time. A confirmation email will be sent to your nominated address.
3.6  We may accept or reject any order for any reason (e.g. Goods unavailable, pricing error, suspicious quantity). If we do not reject an order within 15 business days it is deemed accepted.
3.7  If we reject an order, we will notify you and refund any payment in full within a reasonable time.
3.8  You may not purchase Goods for resale or trade. We may contact you regarding large orders and may reject them per clauses 3.5–3.7.

4  Payment

4.1  You must pay in full at checkout using one of the payment methods displayed on the Website. You must be authorised to use that method and it must have sufficient funds.
4.2  If payment cannot be processed, the order will not proceed and you will not be contacted.
4.3  You authorise Catalyst Brew to debit your nominated payment method for the total amount.
4.4  You must not pay, or attempt to pay, using fraudulent or unlawful means.
4.5  A tax invoice will be emailed to you once payment is processed.

5  Price

5.1  All Prices are in Australian Dollars (AUD) and include GST where applicable. Delivery fees (which may include GST) may also apply.
5.2  Prices may change at any time without notice.

6  Risk, Title & Delivery

6.1  Title and risk in Goods pass to you upon delivery.
6.2  Orders are delivered via Australia Post standard parcel service (or another carrier at our discretion). Delivery terms are detailed in our Ordering, Payment & Delivery Policy, incorporated into these Terms of Use and subject to change.
6.3  Delivery fees are charged as set out in the Delivery Policy.

7  Availability of Goods

7.1  Goods may be out of stock or unavailable. Within 5 business days we will contact you to arrange a refund, substitution, or other solution. If no agreement is reached, we will cancel the unavailable item(s) and refund you.
7.2  We may withdraw or suspend any Good on the Website at any time without notice.

8  Returns & Refunds

8.1  Our Warranty, Returns & Refund Policy applies to all purchases and forms part of these Terms. It may be amended without notice. It is in addition to your rights under Australian Consumer Law.
8.2  Refunds (where applicable) are credited to the original payment method.

9  Warranty & Liability

9.1  Our Goods come with guarantees that cannot be excluded under Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for foreseeable loss. You are also entitled to have Goods repaired or replaced if they fail to be of acceptable quality and the failure is not major.

9.2  Subject to non‑excludable rights and to the fullest extent permitted by law:
(a) All implied terms and warranties are excluded.
(b) We disclaim all warranties as to accuracy, reliability or timeliness of information on the Website or linked sites.
(c) Our liability for breach of any warranty regarding Goods is limited, at our option, to replacement or supply of equivalent Goods.
(d) We are not liable for indirect, special, economic or consequential loss, or loss of revenue, profit, goodwill, data or opportunity.
(e) Our liability is reduced to the extent you caused or contributed to the loss.

9.3  We do not warrant that:
(a) the Website or its server are virus‑free;
(b) Website functions will operate uninterrupted or error‑free;
(c) defects will be corrected.

9.4  We are not liable for:
(a) errors or omissions on the Website or linked sites;
(b) delays, interruptions or cessation of services;
(c) defamatory, offensive or illegal conduct of Website users.

10  Intellectual Property

10.1  Copyright in Website material is owned by or licensed to Catalyst Brew.
10.2  You may download material for personal, non‑commercial use, provided copyright and trademark notices remain intact.
10.3  Except as permitted in 10.2, you must not:
(a) reproduce, distribute or re‑transmit material;
(b) upload or repost material elsewhere on the web;
(c) frame the Website; or
(d) use any trade marks without prior written consent.

10.4  All trade marks on the Website are owned or used under licence by Catalyst Brew. Use requires written consent.
10.5  We may change or correct Website content at any time without notice.

11  Your Use of the Website

You must not:
(a) use the Website for unlawful activity or to infringe third‑party rights;
(b) tamper with the Website or transmit malware;
(c) reverse‑engineer any part of the Website;
(d) hinder other users or engage in defamatory, harassing or offensive conduct;
(e) make fraudulent or speculative orders;
(f) violate network security or engage in illegal conduct;
(g) attempt or permit others to do any of the above.

12  Third‑Party Websites

12.1  The Website contains links to third‑party sites not under our control.
12.2  Links are provided for convenience; they do not constitute endorsement. We are not responsible for third‑party content.

13  Termination

13.1  We may terminate your Website access and membership immediately, with notice, for any reason (including suspected breach or unlawful use).
13.2  Accepted orders will still be supplied per these Terms.
13.3  You may terminate your account at any time without notice.

14  Privacy Policy

Our Privacy Policy (available on the Website) governs collection and use of personal information and forms part of these Terms.

15  Miscellaneous

15.1  We may give notice via email to your account address. You may email us at contact@catalystbrewcoffee.com. Email is deemed received when sent unless outside business hours (then next business day).
15.2  We may amend these Terms at any time. Review before each order.
15.3  We may cancel your membership at any time without notice for any reason including breach or attempted fraud.
15.4  If any part of this Agreement is void or unenforceable, it is severed and the remainder continues in force.
15.5  This Agreement is governed by the laws of New South Wales, Australia. The parties submit to NSW courts.

16  Subscribe & Save Terms and Conditions

16.1  Subscribing signifies acceptance of these Terms.
16.2  Stock is subject to availability.
16.3  After the initial order, recurring orders generate weekly, fortnightly or monthly (as selected) and ship under the Delivery Policy.
16.4  Address changes made via your account take effect within 24 hours. Failure to update before an order is generated may result in mis‑delivery with no refund.
16.5  Auto‑renewal – subscriptions renew automatically until cancelled by:
(a) logging into your account; and
(b) cancelling under Manage Subscriptions.
16.6  Cancelling before the end of a prepaid cycle does not entitle you to a refund.
16.7  Your statutory rights are unaffected.
16.8  We may cancel your subscription at any time for breach of these Terms or discontinue the Subscribe & Save service at our discretion.
